A complaint that alleged WhatsApp for pursuing unfair enterprise practices with respect to digital funds market within the nation has been rejected by the Competition Commission. It was allegedly claimed that Facebook-owned WhatsApp; has abused its dominance within the “marketplace for web-based mostly messaging software via Smartphone’s” in order to control other markets. The market for UPI enabled digital cost purpose in its favour.
Competition Commission of India (CCI) has issued a 41-page order that mentions out that there was no violation of Section 4 of the Competition Act by the common messaging platform i.e. WhatsApp. And, it also mentioned that this part pertains to abuse of dominant place.
In order to do the unbiased and right access to the complaint, the Competition Commission thought of two related markets i.e. the marketplace for Over-The-Top (OTT) messaging apps via smartphone in India and marketplace for UPI (Unified Payment Interface) enabled Digital Payment Interface) enabled Digital Payments Apps in India.
According to the CCI, the informant has contended that WhatsApp will leverage its dominance within; the upstream market to have an aggressive edge over current rivals. The informant also seems to be distressed by the truth that while the; other existing players spent considerable resources to establish themselves in the UPI-enabled digital payment app market; WhatsApp will get users on its platter without making any efforts.
CCI also noted that “The apprehensions of the informant, according to Commission, do not really hold much merit. As stated above, the UPI market is quite established with renowned players competing vigorously. In such a market, it seems implausible that WhatsApp Pay will automatically garner a market share merely on account of its pre-installation.”
Having stated the truth that the WhatsApp ecosystem doesn’t contain paid providers as such for regular customers; it appears unlikely that the buyer’s site visitors shall be diverted by WhatsApp utilizing its energy within the messenger market; as per the order dated August 18.
